PRENUPTIAL AGREEMENTS

A significant percentage of marriages end in divorce. Whether you are entering your first marriage or have previously been married, a prenuptial agreement is a crucial planning tool that can protect your and your family’s financial future. Prenuptial agreements can help you avoid expensive and protracted litigation should your marriage end in divorce. Prenuptial agreements are especially important for high net worth individuals, business owners, people with children from previous relationships and people who may be set to inherit or otherwise come into money during the marriage.

Entering into a prenuptial agreement has positives and negatives for both parties. It serves to bring clarity to division of marital and non-marital property. However, it can deny a spouse certain financial rights that they would otherwise be entitled to under Florida Law, such as spousal support, contributions to financial accounts during the time of a marriage and attorney’s fees. At the Law Office of Gloria Gonzalez, we are here to walk you through the steps of the prenuptial agreement

Prenuptial agreements should be done in a sufficient period of time before a wedding. To avoid later claims of coercion in the signing of the prenuptial agreement, each party needs time to contemplate and negotiate the terms of the Agreement if necessary. A full and accurate financial accounting must be provided to the other party at the time of presentation of the Agreement or you run the risk of your soon-to-be ex-spouse from seeking to invalidate the Agreement based on this crucial component. That is why you need the help of an experienced attorney to help protect your rights and Attorney Gloria Gonzalez is here to help you in all aspects of the process.

Prenuptial agreements are often held to be unenforceable by the Courts. At the Law Office of Gloria Gonzalez, we will work with you to create a Prenuptial agreement that is tailored to your unique circumstances and is properly drafted to contain all of the details to ensure that the Prenuptial is held to be valid by the Court, should divorce litigation later arise.

SAME SEX MARRIAGE AND DIVORCE

The laws regarding marriage equality are changing fast and furious. State laws, yet to be

determined, affect many aspects of a divorcing same-sex party’s rights, such as: health issues, insurance, parental rights, property distribution, civilian and military service benefits, taxation and property issues to name a few. As the laws have changed so drastically during the recent years, laws are struggling to keep up. The distinctive challenges that same-sex couples will encounter when navigating through a divorce are yet to be seen. Now, as same sex divorce becomes and emergent area, new issues must be considered: determination of parentage for a child born during the marriage? Equitable distribution of assets? Is the determination of the duration of the marriage the standard? What about if there was a domestic partnership prior to the marriage?

As is to be expected, with an increase in marriages, there will likely be an increase in divorces There is no precedent established to know how individual judges will rule on issues. It is therefore vital for you to have an attorney who is knowledgeable and is following the change in the statutes and Florida case Law. Attorney Gloria Gonzalez prides herself on remaining current on the law and the ever-changing landscape of same sex marriage and divorce.

PATERNITY

In Florida, paternity of a child is a key factor in determining whether a man will be held responsible for child support and whether he will be entitled to timesharing with and parental responsibilityofachild. Mothersoftenfilepaternityactionsinordertoobtainchildsupportorto establish a set timesharing schedule between the Father and the minor child. Fathers typically file paternity actions to establish their rights as a father to have timesharing with the child and to participate in major decisions in the child’s life. There are several different ways to establish paternity in Florida:

  1. Marriage: Parents are married to each other when a child is born.
  2. Acknowledgement ofpaternity: An unmarried couple assigns paternity in an officialpaternity agreement.
  3. Genetic testing: A genetic test proves fatherhood and there is not already a legal father.
  4. Court order: A judge orders legal paternity in a paternity action.
  5. Legitimation: Mother and biological father marry after the child is born and update birthrecords.

In Florida, pursuant to Florida Statute 742.18, it is possible to “disestablish” paternity if

you learn that you are not the biological father of a child, even after you have been ordered to pay child support. The Law Office of Gloria Gonzalez is able to help you disestablish paternity and file a proper Petition to Disestablish Paternity and strictly comply with the language contained in the statute.
